These terms are an agreement between you and The Dumb Zone (“we”, “us”) covering the website at dumbzone.app and The Dumb Zone mobile apps (the “app”). By using the app you agree to them. If you do not agree, please do not use it. Our Privacy Policy explains how we handle your information.
Your account
You can browse and listen to free episodes without an account. Some features need you to sign in. Keep your sign-in secure and tell us at support@dumbzone.app if you think someone else is using your account. You must be at least 13 to create an account, and old enough to agree to these terms where you live.
Premium access
Premium episodes and features unlock through a paid membership you hold with a third party, such as Patreon or Substack. Those memberships are sold, billed, renewed, cancelled and refunded by that third party under its own terms; we do not charge you in the app. When you link a membership we check its status, and premium access follows it: if the membership ends, lapses or is refunded, premium access in the app ends too. We may also grant premium access ourselves at our discretion. Which episodes and features are premium can change over time.
Comments and community
Comments, display names and anything else you post are your responsibility. Do not post anything unlawful, threatening, harassing, hateful, sexually explicit, misleading about who you are, spam, or that infringes someone else's rights, and do not share other people's personal information. You keep ownership of what you post, and you give us a non-exclusive, royalty-free, worldwide licence to host, display and share it within the app and in the show's promotion. We may remove content or restrict accounts that break these rules, at our discretion and without notice.
Leaderboard and games
The leaderboard ranks listening activity, and your name only appears on it if you opt in. Games and contests, such as weekly picks, are for fun unless their own rules say otherwise. Rankings and results are based on our records, and we may correct them, reset them, or disqualify activity that looks automated or manipulated.
Our content
Episodes, audio, video, artwork, transcripts and the app itself belong to The Dumb Zone or its licensors. You may stream them for personal, non-commercial use. Do not download, copy, redistribute, re-upload or resell premium content, share premium access with people outside your account, or scrape, reverse engineer or interfere with the app.
Sponsors and links
The app features sponsors and links to other sites and services, including YouTube, Patreon and Substack. We are not responsible for their products, offers or content, and your dealings with them are between you and them.
Changes and ending use
We may change, pause or discontinue any part of the app. You can stop using it and ask us to delete your account at any time (see the Privacy Policy). We may suspend or end your access if you break these terms or if we have to for legal or security reasons.
Disclaimers
The show is commentary and entertainment. Nothing in it is professional, financial or betting advice. The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We do not promise it will always be available, error free, or that any particular episode will stay online.
Limitation of liability
To the fullest extent the law allows, The Dumb Zone and the people who make and run the app are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim about the app is limited to the greater of the amount you paid us directly for it in the twelve months before the claim, or US $50. Some places do not allow these limits, so they may not all apply to you.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Texas, unless the law where you live gives you the right to bring it elsewhere.
Changes to these terms
We may update these terms. We will change the date above, and for significant changes we will let signed-in listeners know in the app. Continuing to use the app after a change means you accept the new terms.
